Residential-Agricultural District — Article VII, and the district most Sidney land outside the hamlets falls in. MINIMUM LOT AREA 5 ACRES, amended 2023-01-13; lot width at building line 100 ft; front yard 40 ft; maximum height 36 ft for residential buildings, with FARM STRUCTURES EXPRESSLY EXEMPT FROM ANY HEIGHT LIMIT. The side and rear yard figures are stated twice over — 10 ft for an ACCESSORY structure and 25 ft for a PRIMARY structure. sideSetback and rearSetback record the 25 ft primary-structure figure, which is the one that governs a house. This district states TWO different width figures and they diverge by 150 ft: lot width at the building line is 100 ft, but § 702(6) separately requires a MINIMUM ROAD FRONTAGE OF 250 FT (amended 2023-01-13). minLotWidthFt records the 100 ft lot width because that is the field’s basis and the code’s own term, but on any new lot the 250 ft road-frontage requirement is what actually governs how many lots a road-fronting parcel can yield, and it is 2.5x the recorded figure. On a long thin parcel that requirement, not the 5-acre minimum, is what caps the lot count. USES ARE THE MOST PERMISSIVE IN THE TOWN: § 700 incorporates everything permitted in the R and MD districts and adds agricultural, floricultural and horticultural pursuits including general farms, greenhouses, nurseries, truck gardens, dairies and the raising of bees, poultry and livestock with all customary buildings; forest management; seasonal dwellings; animal hospitals, riding stables, kennels and furbearing animal farms provided pens and runways sit at least 100 ft from any adjoining property line (pasture and exercise tracks excepted); and MULTI-FAMILY DWELLINGS AS A PERMITTED PRINCIPAL USE, which is unusual for a 5-acre rural district and the most permissive residential provision found in this county so far. Maywood District — Article VI-B, and a genuinely unusual district: § 600-B states that ALL PERMITTED USES WITHIN THE MAYWOOD DISTRICT WILL REQUIRE A SPECIAL USE PERMIT, so nothing here is as-of-right even though the section is headed “Permitted Principal Uses”. MINIMUM LOT SIZE IS NOT A NUMBER: § 601-B(4) sets it as “required to accommodate the proposed property use as determined by the Planning Board during Site Plan Review”, so minLotSize is null by design and no lot width or road frontage is stated either — those nulls are the code’s position, not unread fields. What IS fixed: front yard 25 ft, side and rear 25 ft for primary structures and 10 ft for accessory structures, and a maximum height of 36 ft measured FROM THE LOWEST GROUND ELEVATION, which is a stricter basis than the two-and-a-half-storey formulation used in the residential districts and matters on a sloping site. The district is a small mixed-use node: it incorporates the SC-R use list, then adds by special permit retail business (small), personal service shops, galleries, artist and music studios, cafés, business or professional offices, custom-work shops for trades such as woodworking, plumbing and electrical using only light machines and hand tools, building and farm supply with incidental millwork, feed and solid fuel storage, farm implement sales, service, rental and auctions, utility service buildings and storage yards when fenced, residential or solar installations specific to the business, assisted living facilities, group homes, senior housing and housing for the disabled under NYS Department of Health codes, major home occupations, large wind projects, commercial solar arrays and farms, and commercial recreation establishments. 25 / 25 / 25 ft 36 ft No
Commercial District — Article VIII. Like the Maywood District it sets NO numeric minimum lot size: § 801(8) makes lot area “minimum lot size as required to accommodate the proposed property use as determined by the Planning Board during Site Plan Review”, so minLotSize, minLotWidthFt and maxLotCoverage are all null by design rather than unread. Front yard 25 ft; side and rear 25 ft for primary structures and 10 ft for accessory structures; maximum height 36 ft measured FROM THE LOWEST GROUND ELEVATION. The practical consequence is that every commercial project in Sidney is a Planning Board site plan review in which the dimensional envelope is set case by case, so there is no schedule to underwrite against and an early conversation with the Board is the only way to size a scheme. Signs in this district confine all advertising to the premises of the business advertised, cap a wall identification sign at two square feet per horizontal foot of the wall it sits on and at 75% of that wall’s width (90% where the wall is 20 ft or less), and allow a maximum 12-inch projection with no part extending above or beyond the wall. 25 / 25 / 25 ft 36 ft No
Common Plan of Development Overlay — Article V-B, ADDED 2023-12-14 and the newest zoning instrument found in Delaware County. AN OVERLAY, NOT A STANDALONE DISTRICT: height, front setback, and side and rear setbacks are all expressly “same as the underlying district”, which is why those fields are null here. Three things change, and they are strict. MINIMUM LOT SIZE 10 ACRES and MINIMUM FRONTAGE 250 FT — the largest minimum lot in the town by a factor of two against RA’s five acres. MAXIMUM LOT COVERAGE 30%, WHICH IS THE ONLY LOT-COVERAGE FIGURE ANYWHERE IN THE TOWN OF SIDNEY ZONING LAWS; every base district states none. AND READ THE TOWN’S OWN COVERAGE DEFINITION BEFORE APPLYING IT: § 300 defines lot coverage as the portion of the lot covered by the horizontal cross section of all principal AND accessory buildings, PAVED PARKING LOTS, AND OTHER IMPERVIOUS SURFACES — so this 30% is an impervious-surface cap, not a building-footprint cap, exactly as in the Town of Delhi, and on a 10-acre commercial or solar site the parking and access drives consume it fast. Maximum lot depth-to-width ratio 4:1. The front setback carries an additional contextual rule: same as the underlying district, OR, where adjacent lots are developed, no new building line may cross the front plane of the closest buildings on adjacent lots. PROCEDURE IS THE OTHER TEETH: § 506-B requires any application for subdivision, site plan approval or a special use permit within the CPD to notify IN WRITING BY CERTIFIED MAIL every property within 1,000 FEET of the outside border of the parcel, with proof of mailing at time of application — an unusually wide notice radius that adds real time and cost to a schedule. 10 ac No

ADUs vs. short-term rentals in Sidney

Short-term rentals restricted for Town of Sidney. Short-term rentals have no as-of-right path in the Town of Sidney, and the reason is structural rather than an express ban — read this before assuming either permission or prohibition. THE TOWN PLAINLY THOUGHT ABOUT IT: Article III defines "AIR BNB" in terms, as "an online marketplace which lets people rent out their properties or spare rooms to guests", and separately defines BED-AND-BREAKFAST as a private residence with at least two and not more than five guest rooms rented to transient guests with food service in the morning only, which must be the operator’s prime residence and may employ no more than two people outside the family. THEN NEITHER TERM APPEARS ANYWHERE ELSE IN THE 116-PAGE LAW. Both are defined and then never used: neither is a permitted principal use, a permitted accessory use, or a special permit use in ANY of the five base districts. THAT SILENCE IS NOT NEUTRAL HERE, BECAUSE THIS CODE IS EXPLICITLY CLOSED-LIST AND UNUSUALLY STRICT ABOUT IT. § 503 Equivalent Uses says that where a use is not listed as permitted in any district, the Code Enforcement Officer refers it to the Planning Board for an interpretation, which may recommend to the Town Board that the Local Law be AMENDED — and then states that "in no case shall a building permit be issued for an equivalent use until the Local Law has been amended to permit such equivalent use in the appropriate zoning district." Most codes let a zoning board interpret an unlisted use onto an existing category; Sidney requires an act of the Town Board. So the lawful route to an STR here is a text amendment, not a permit — which is why this is recorded restricted rather than permitted or prohibited. RECORDED AS AN INFERENCE FROM THE CLOSED-LIST CLAUSE, NOT AS A QUOTED RULE. There is no sentence anywhere saying short-term rentals are forbidden, and in a rural town of this size the Code Enforcement Officer’s practice may be considerably more permissive than § 503 reads. WORTH RAISING WITH THE TOWN AS A DRAFTING DEFECT: defining two transient-lodging terms in a law adopted 2021 and amended twice in 2023, and then listing neither as a use in any district, looks like an omission rather than a decision — particularly for the bed-and-breakfast, whose definition is detailed enough (guest-room count, owner-occupancy, employee cap) to have been drafted for a district it never reached. These are separate questions from whether you can build an ADU — a unit you're allowed to add isn't automatically one you're allowed to rent nightly, so check both.
