Town of Walton, NY: zoning for new construction
The Town of Walton sets a residential minimum of about 2 acres in Rural II District — the ROAD-CORRIDOR district. § 200-16 defines it geographically rather than by map colour: it is all land within 1,000 feet of the CENTER LINE of a state or county road, and all land within 500 feet of the center line of a TOWN road, in each case with direct frontage AND direct access to that road. Minimum lot size 2 acres; minimum frontage 200 feet of continuous road frontage. Maximum height 35 ft. Side and rear yards 25 ft each. Maximum lot coverage 25% — a genuine building-coverage maximum, not an inverse green-space figure. § 200-16 reads "75 feet from center line of road or 50 feet from edge of road right-of-way if said right-of-way is greater than 50 feet wide". On a NARROWER right-of-way the centerline rule binds harder: a 33 ft ROW pushes the building back about 58 ft from the lot line. Check the actual ROW width before siting. There is also a MAXIMUM LOT DEPTH-TO-WIDTH RATIO of 8:1, which rules out the deep flag-shaped lots that rural subdivisions often produce. § 200-16 further allows land zoned R-5 to be folded into a lot being subdivided in R-2 provided the lot is at least 2 acres and the 8:1 ratio still holds. The code states cul-de-sac frontage as "75 inches", which is plainly a typographical error for 75 feet — do not read it literally. Permitted principal uses are one one-family or two-family dwelling per lot, one mobile home per lot, agriculture, forest management and wildlife management. Amended 1-8-2024 by L.L. | Rural V District — the BACKLAND district, covering everything outside the R-2 road corridor (see the R-2 label for how the corridor is measured). Minimum lot size 5 acres; minimum frontage 300 feet of continuous road frontage, 100 feet on a cul-de-sac. Maximum height 35 ft. Side and rear yards 25 ft each. Maximum lot coverage 20% — a genuine building-coverage maximum. Front setback is stated identically to R-2 as "75 feet from the center line of road or 50 feet from edge of right-of-way if said right-of-way is greater than 50 feet wide"; 50 is recorded for the same lot-line-basis reason given in the R-2 label, and the same narrow-right-of-way caution applies. § 200-17 states NO lot depth-to-width ratio for R-5, unlike R-2's 8:1. Where the DL overlay applies (see the DL zone), subdivision density in R-5 is capped at between 0.15 and 0.09 lots per acre of the ORIGINAL parcel depending on how much of it carries a development limitation, which is 6.7 to 11.1 acres per lot — materially worse than 5 acres. | Industrial District — § 200-18 sets NO minimum lot size and NO minimum frontage, which is why minLotSize and minLotWidthFt are null here rather than zero: the district genuinely imposes no area or frontage floor, and a null is the honest record. Maximum height 50 ft, the tallest in the Town. Maximum lot coverage 85%. Side and rear yards 30 ft. Front setback stated as 75 ft from the center line of the road, recorded as 50 on the same lot-line basis explained in the R-2 label. No lot depth-to-width ratio. | § 200-19 applies to all land shown on the Development Limitations Overlay Map(s) on file in the Town Clerk's office (steep slopes, wet soils and similar constraints). Every dimensional standard except two is inherited: minimum lot size, front setback, side and rear setbacks, maximum lot coverage and the lot depth-to-width ratio are all expressly "same as underlying district", which is why minLotSize, frontSetback, sideSetback, rearSetback and maxLotCoverage are null here — a figure recorded on this row would be a duplicate of R-2 or R-5, and which one depends on the parcel. The TWO standards the overlay sets for itself are MAXIMUM HEIGHT 35 ft and MINIMUM FRONTAGE 50 FEET MORE than the underlying district (only 10 feet more on a cul-de-sac) — so R-2 land under DL needs 250 ft of frontage and R-5 land needs 350 ft. THE REAL CONSTRAINT IS THE SUBDIVISION DENSITY TABLE, expressed as the maximum number of lots allowed PER ACRE OF THE ORIGINAL PARCEL, graduated by how much of that parcel carries one or more development limitations: under 25% limited → 0.36 lots/acre in R-2 and 0.15 in R-5; 25% to 50% → 0.36 and 0.14; 50.1% to 75% → 0.26 and 0.10; over 75% → 0.22 and 0.09. Inverted, that is 2.8 to 4.5 acres per lot in R-2 (against a 2-acre minimum) and 6.7 to 11.1 acres per lot in R-5 (against a 5-acre minimum). The denominator is the ORIGINAL parcel, so the cap is computed once against the parent tract rather than re-earned by each resulting lot. This row is recorded rather than omitted precisely because it carries its own height, its own frontage rule and this density table; contrast the practice elsewhere in the dataset of omitting overlays that are "same as underlying" in every column. Short-term rentals
Short-term rentals allowed with local rules. Chapter 192 TRANSIENT RENTAL REGULATIONS (a standalone chapter, NOT part of the zoning chapter) is a full permit regime. § 192-4 defines a TRANSIENT RENTAL UNIT as any dwelling unit rented or leased for 30 DAYS OR LESS to one entity, and the chapter runs Purpose (§ 192-1) through Authorization (§ 192-5), Fee (§ 192-7), Application forms (§ 192-8), Application process (§ 192-9), Inspections (§ 192-10), General permit regulations (§ 192-11), Complaints (§ 192-12) and Violations/penalties (§ 192-13), plus renewal applications. Off-street parking may not be used for RV parking or camping while the unit is rented. SEPARATELY AND IMPORTANTLY, § 200-61.1F(4) of the zoning chapter bars an ACCESSORY DWELLING UNIT from being used as a short-term transient rental — so an ADU built under § 200-61.1 cannot be the STR unit, and the two programs do not stack.
