TANNERSVILLE'S GOVERNING STR LAW IS NOW LOCAL LAW No. It was PASSED BY THE VILLAGE BOARD OF TRUSTEES ON 21 AUGUST 2025 AND FILED WITH THE NEW YORK DEPARTMENT OF STATE ON 22 SEPTEMBER 2025; the Village's own Short Term Rentals page states the regulations are 'now in effect', all STRs within the Village must be permitted to operate, and the registration portal is live. Enforcement was deferred 180 days from the effective date to let the Code Enforcement Officer process applications. Read in full 2026-08-27 from the filed text. AN STR IS 'a dwelling unit that is rented, in whole or part, ... for a period of less than 30 consecutive nights', expressly including a single- or two-family dwelling, multiple family dwelling, condominium, townhouse, guest house, cottage, cabin or RV; hotels, bed-and-breakfast establishments and dormitories are excluded, and an owner's own use of the unit is not a rental. Hosted and Unhosted Property are both defined, and UNHOSTED INVESTOR OPERATION IS NOT BARRED. THE PERMIT IS A SPECIAL PERMIT UNDER THE ZONING LAW. § 1.B establishes the STRP requirement 'for all short-term rental units within the corporate boundaries of the Village of Tannersville IN ALL ZONES of the present or Future Zoning laws, which shall be deemed a Special Permit use under the Zoning law.' THE COMMERCIALLY DECISIVE TERMS. The permit runs ONE YEAR (§ 3.B), and § 10.A requires the renewal application at least 60 days before expiry with proof that all Village taxes and water rates are current. THE PERMIT IS NOT TRANSFERABLE TO A NEW OWNER — a purchaser must file a fresh application (§ 3.C). Properties with existing rental commitments when the law took effect could honour them but had to apply within 180 days, and if the application is denied ALL COMMITMENTS MUST BE CANCELLED. MAXIMUM OVERNIGHT OCCUPANCY is two per bedroom plus two additional occupants; any unit that can hold MORE THAN ELEVEN people may require SITE PLAN APPROVAL FROM THE VILLAGE PLANNING BOARD before the CEO issues a permit. Daytime guests are capped at twice the nightly occupancy, with occupants counted between 10 p.m. and 6 a.m. Insurance must cover the value of the dwelling PLUS A MINIMUM OF $500,000 for third-party property damage or bodily injury. Well-supplied units need a potable-water test meeting Subpart 5-1 of the NYS Sanitary Code, retested at every annual renewal. Fire extinguishers must be inspected before each renter occupies. Application and inspection fees are set by Village Board resolution — the current fee schedule is published on the Village's STR page. SEPARATELY, GREENE COUNTY OPERATES A FREE SHORT-TERM-RENTAL REGISTRATION through its Customer Portal, and New York State now collects sales tax on short-term rental transactions — register with the County as well as the Village (str@greenecountyny.gov, (518) 943-3223).
