They are available only in a Restricted Business, Commercial or Mixed Use District, and there only with a building permit and certificate. A bed-and-breakfast is a separate use under § 208-28.3A and needs a special permit from the Board of Appeals after a public hearing. New York State's 2025 short-term rental registry (Ch. 99 of the Laws of 2025) separately requires every host statewide to register the unit regardless of local law.
