Short-term rentals allowed with local rules. Short-term rentals need a Village permit AND the eligibility rules decide most cases — THIS IS AN OWNER-OCCUPIED, TWO-ZONE REGIME. Local Law No. 2 of 2021 adds § 22.2 to the Village Code and defines a short-term rental as offering a residential dwelling or space within it for compensation for less than 30 days. § 22.2(A) permits them ONLY in the R-2 and R-3 residential zones; an R-1 rental that existed at adoption could continue only if it registered with the Building Department within 30 days. § 22.2(B) limits them to single-family dwellings and accessory buildings holding a certificate of occupancy on the same tax lot, and expressly bars two-family, three-family and multiple dwellings. § 22.2(C) requires the property to be OWNER-OCCUPIED — the record owner's own domicile — so a non-resident investor purchase does not qualify. § 22.2(D) requires registration before use, § 22.2(E) bars new parking between the house and the street, and a resident agent must be an individual living in Orange County, reachable for emergencies. One exception worth knowing: § 22.2(F) requires no permit to rent a single bedroom, however many days. Tenants may not sublet (§ 22.2(G)(2)). New York State's 2025 short-term rental registry (Ch. 99 of the Laws of 2025) separately requires every host statewide to register the unit regardless of local law.
