The standard is stated as a DENSITY — ONE DWELLING PER FIVE ACRES — with a separate ONE-ACRE MINIMUM LOT SIZE. The recorded 1 acre is the smallest lot that may be created; the five-acre density is what determines how many lots a parcel yields. A 50-acre Rural parcel supports ten dwellings, not fifty, however small the individual lots are drawn. Anyone sizing a Rural project from the one-acre figure will overstate yield fivefold. 250 ft minimum lot width (see § 138-19 for the flag lot frontage exception). | Senior Housing District (a FLOATING DISTRICT created parcel by parcel under Article XIII § 138-51 rather than pre-mapped, and the only route to multiple dwellings in the Business District. It has no Attachment table — its dimensional requirements are stated inline in § 138-51J(2) and they are demanding: MINIMUM LOT SIZE 20 ACRES, minimum road frontage 400 ft, minimum front yard from adjoining roads 80 ft, and minimum building setbacks from adjoining properties of 100 FT ON BOTH SIDE AND REAR. Maximum building height 40 ft. The 20-acre threshold is a qualifying site area for the district designation, not a per-lot minimum, and it is what makes this a large-assemblage play rather than an infill one. maxLotCoverage IS NULL BY DESIGN: § 138-51J(2)(f) states a MINIMUM OPEN SPACE OF 60% of the parcel or combined parcels rather than a coverage maximum — an inverse standard, and the same convention applied across Saratoga County. TWO FURTHER CAPS COME FROM § 138-125: the maximum footprint of any individual building is 20,000 sf (increased only by participating in the Green Energy Incentive Program under Article XVII), and the maximum length of any individual building containing single-family attached, townhouse or multifamily units is 200 LINEAR FEET regardless of unit count. ADUs vs. short-term rentals in Ballston
No local short-term-rental law on record - which is not the same as permission for Town of Ballston. No short-term-rental provision exists in the Town of Ballston Zoning Law. Chapter 138 defines no short-term rental, vacation rental or transient-occupancy use, creates no registration or licensing requirement, and none of the eleven district use tables (Attachments 2 through 11) lists one. THE CLOSED-LIST LANGUAGE MATTERS MORE HERE THAN IN MOST TOWNS: every Ballston district table carries the express note 'Any uses not listed on this table are prohibited', which is a stronger formulation than the implied closed lists found in Clifton Park and Malta — in Ballston a use that does not appear on the table is prohibited by the table's own terms, not merely unaddressed. The only enumerated transient-lodging use is the BED-AND-BREAKFAST, which appears in the Rural, Ballston Lake Residential, Burnt Hills Commercial, Mixed Use Route 50/67, Rural Highway Transition and Business district tables and is permit-gated in each.
