The Town of Clifton Park sets a residential minimum of about 10 acres in Planned Development District. THE ONLY FIXED NUMBER IN THIS DISTRICT IS THE QUALIFYING SITE SIZE, WHICH IS WHY EVERY OTHER FIELD IS NULL — that is the correct record of a negotiated district, not missing data. Minimum area for consideration of a Planned Development District designation is 10 CONTIGUOUS ACRES, EXCEPT within the Town Center Zoning Districts TC1, TC2, TC3, TC4, TC5 and TC6, where NO minimum area requirement applies at all — so inside the Town Center a PDD can be sought on any size parcel, which is the main route to exceeding the Town Center's own form and density standards. No. 5-2005; a district mapped on the Zoning Map, not a floating overlay, and no parcel in existence as of March 1, 2005 may be reconfigured to escape it). THE MINIMUM LOT SIZE IS NOT THE BINDING CONSTRAINT HERE — DENSITY IS, and the gap between the two is the single most important fact about this district. Hamlet Residential (§ 208-17, added 5-9-2005 by L.L. No. 5-2005; covers Western Clifton Park and the Hamlet of Rexford, and new development must follow the Western Clifton Park Design Guidelines). LIKE CR, DENSITY AND NOT LOT SIZE IS THE BINDING CONSTRAINT: § 208-17C sets a BASE DENSITY OF 0.33 DWELLING UNIT PER ACRE — roughly one unit per three acres — against a minimum lot size of only 6,000 sf. A builder reading the 6,000 sf figure alone would overstate yield by an order of magnitude. Town Center - Boulevard (Article IIIA, § 208-22.1; the primary boulevard through the Town Center, mixed-use buildings up to five stories with dwelling units permitted ONLY above commercial space). THIS IS A FORM-BASED ZONE AND ITS NULLS ARE THE CORRECT RECORD, NOT MISSING DATA. There is no minimum lot AREA and no lot coverage percentage anywhere in the Town Center; the zone regulates lot CONFIGURATION instead — minimum lot width 150 ft and minimum lot depth 300 ft. The front standard is a BUILD-TO LINE at 41 ft from the property line, an exact required placement rather than a minimum setback, so frontSetback is null: a building must sit AT 41 ft, not at least 41 ft. Within that 41 ft the section prescribes the streetscape itself — 8 ft minimum sidewalk, 15 ft minimum landscaped terrace, 8 ft multi-use path to NYSDOT standards, 10 ft minimum tree lawn and a 3 to 5 ft pedestrian footway. Side street build-to line 0 ft. Short-term rentals

No local short-term-rental law on record - which is not the same as permission. Clifton Park has NO short-term-rental law. The phrase does not appear in Chapter 208, there is no STR definition in § 208-7, and a full read of the Town Code's chapter list confirms no rental, lodging or STR chapter exists among the roughly sixty chapters of Part II General Legislation — Chapter 129 governs Hotels and Motels and Chapter 189 governs Transient Retail Merchants, which is peddling, not lodging. That silence is NOT permission, and in Clifton Park's case the zoning text points the other way for three converging reasons. First, Chapter 208 is a CLOSED-LIST permissive code: § 208-10B and § 208-8B each provide that no building or land shall be used for any purpose OTHER THAN those enumerated, so a use that is not listed is not allowed. Second, § 208-7 defines DWELLING to expressly EXCLUDE tourist homes, motels, hotels and other structures designed or used for TRANSIENT RESIDENCE — so renting a dwelling transiently arguably takes it outside the residential use under which it is permitted. Third, the only enumerated short-stay use in the residential districts is the BED-AND-BREAKFAST, defined in § 208-7 as a house or portion of a house where short-term lodging rooms AND MEALS are provided for in-house guests, and it is a § 208-79 SPECIAL USE — available by permit in R-3, R-1, CR and HR but not as of right anywhere. A boardinghouse, defined as a dwelling in which three or more rooms are offered for rent, is a separate and separately regulated use.
