What the Stuyvesant code indicates by district

The table below shows how each district treats ADUs, alongside the lot and setback standards that govern a second unit. District boundaries and conditions vary, so treat this as a starting point and confirm the district that applies to your parcel.

District Min lot Setbacks F / S / R Max height ADU
Hamlet 1 0.41 ac 40 / 25 / 50 ft 35 ft Occupancy restricted
Hamlet 2 0.41 ac 40 / 25 / 50 ft 35 ft Occupancy restricted
Agricultural 5 ac 40 / 25 / 50 ft 35 ft Occupancy restricted
Hamlet Extension 1 ac 40 / 25 / 50 ft 35 ft Occupancy restricted
Shoreline (follows Hamlet Extension standards) 1 ac 40 / 25 / 50 ft 35 ft Occupancy restricted
Commercial/Light Industrial 35 ft No

Hamlet 1, Hamlet 2 — MINIMUM LOT SIZE IS SET BY THE COLUMBIA COUNTY HEALTH DEPARTMENT, not by this schedule (note *). It is arrived at by applying the Health Department standards for an on-lot well and septic system to the parcel and then adding the required setbacks. The 0.41 acres recorded above is the code's own worked illustration — "the minimum lot size including a 30' x 50' residence would be 150' wide x 120' deep or .41 acres" — and not a fixed minimum. ACCESSORY-USE SETBACKS DIFFER AND HAVE NO FIELD: an accessory building takes the same 40 ft front yard, but 10 ft side and rear for a residential accessory use and 25 ft for an agricultural one, against 25 ft and 50 ft for a principal building. Minimum lot FRONTAGE is 60 ft — a separate requirement from the lot width above, which is measured at the required front-yard setback.

Agricultural — DENSITY AVERAGE is a separate figure from the minimum lot size (note **): the total developable area of a parcel divided by the acres required per use. A requires 5 acres per use. The clustered-subdivision lot width is recorded as a variant; the conventional 300 ft is the base.

Hamlet Extension — DENSITY AVERAGE is a separate figure from the minimum lot size (note **): the total developable area of a parcel divided by the acres required per use. H-EXT requires 1 acre per use. Conventional and clustered subdivisions take the same 150 ft lot width here, so there is no cluster variant.

Shoreline (follows Hamlet Extension standards) — The Shoreline District follows the Hamlet Extension standards. DENSITY AVERAGE is a separate figure from the minimum lot size (note **): the total developable area of a parcel divided by the acres required per use.

Commercial/Light Industrial — C/LI PUBLISHES ALMOST NOTHING. Schedule note *** states that the dimensional requirements of the Commercial/Light Industrial District "will be determined on a case-by-case basis via the State Site Plan Review Process" — so the minimum lot size, every setback and the lot width are left blank on purpose, and the only fixed figures are 60 ft of lot frontage, 75% maximum lot coverage and 35 ft of height. That is not missing data; it is what the schedule says.

ADUs vs. short-term rentals in Stuyvesant

Short-term rentals allowed with local rules for Town of Stuyvesant. Stuyvesant permits short-term rentals subject to a Town permit under LOCAL LAW No. 2 of 2024, 'Establishing Regulations Regarding Short Term Rentals', adopted 14 November 2024 and effective immediately. Read in full 2026-08-27 from the adopted text on the Town's site. Note that the Town's 2018 Zoning Law PDF predates this law and does not contain it; the local law is the authority. AN STR IS ANY PORTION OF REAL PROPERTY OR LIVING UNIT ORDINARILY OCCUPIED FOR RESIDENTIAL PURPOSES 'rented in exchange for lodging for a period of not more than 31 consecutive days' — note 31 days, not the more usual 30. UNHOSTED, INVESTOR-OWNED STRs ARE EXPRESSLY ALLOWED. The law defines Hosted and Unhosted Property, and § 4.F provides that 'all current non-resident owners/operators of STRs may continue operation' on timely application. An Unhosted Property must have a LOCAL PROPERTY MANAGER who lives within the Town or within 30 road miles, whose name, address and phone must be filed with the permit application and updated within five days of any change. THE OPERATIVE TERMS. Every STR needs a permit from the Town Code Enforcement Officer, who inspects within 30 days of a complete application. Occupancy is set by the CEO from the bedroom count under the NYS Building Code and IS CAPPED AT FIFTEEN SLEEPING PERSONS — anything sleeping more than fifteen is not an STR and falls under the hotel/motel rules. ALL PARKING MUST OCCUR ON THE PARCEL; no guest, renter or visitor parking on any road, and failure to comply at all times revokes the permit until remedied. An emergency number must be posted, and ALL EMERGENCY CALLS MUST BE ANSWERED WITHIN SIXTY MINUTES. Liability insurance is RECOMMENDED, not required — the law suggests dwelling value plus $300,000 of third-party cover. The permit term is one year, renewable with a fee set by Town Board resolution; the CEO may inspect annually and MUST inspect every three years. Permits attach to a single tax parcel and ARE ISSUED ONLY TO THE PROPERTY OWNER of the STR being registered. Failing NYS Sanitary Code water standards obliges the operator to tell guests and supply bottled water until fixed. Fire safety follows the National Fire Safety Code with annual extinguisher certification and an affidavit at each renewal; the 911 number must be displayed at the curb in numerals at least four inches high; any STR of five bedrooms or more needs exit placards on the inside of every bedroom door. ENFORCEMENT runs as a zoning violation: 30 days to cure, first violation a warning, then $500, $1,000 and $1,500, and THREE VIOLATIONS IN A CALENDAR YEAR REVOKES THE PERMIT. Appeals go to the ZBA under Town Law § 267-b(1). Confirm current fees with the Code Enforcement Officer at (518) 758-6248. These are separate questions from whether you can build an ADU — a unit you're allowed to add isn't automatically one you're allowed to rent nightly, so check both. Municipal source
