Short-term rentals allowed with local rules. Read in full 2026-08-27 against the codified Town of Jewett Code (294 pp.). A CITATION CORRECTION: the regime was created by § 165-21.5, 'Registered short-term rentals', ADDED 12-11-2019 BY LOCAL LAW No. L.L. No. 1-2021 (adopted 4-14-2021) added subsections C through F, which are where the occupancy, garbage, notice and violation rules live. THE USE TABLES. § 165-8 closes the scheme — 'Any uses not specifically allowed in the following district regulations are prohibited in the Town of Jewett' — and L.L. No. 2-2019 amended all four district sections to add the use. 'Registered short-term rental' is a PERMITTED USE (not a special use) in § 165-9 HR Hamlet Residential, § 165-10 RR Rural Residential, § 165-11 RC Rural Conservation and § 165-12 C Conservation. 'Seasonal rental dwelling' is separately a permitted use in HR, RR and RC and a special use in C. A boardinghouse/bed-and-breakfast, by contrast, is a special use everywhere. The defined term: 'REGISTERED SHORT-TERM RENTAL — Any property or portion thereof, advertised in any fashion including on the internet, for rent for a period less than one month and for which the owner or representative has obtained a registration certificate.' THE OBLIGATIONS. The certificate and an information sheet must be conspicuously posted inside the unit. THE OCCUPANCY RULE IS UNUSUALLY STRICT AND IS THE ONE TO PRICE: occupancy is fixed at registration, 'the occupancy thus determined shall be the maximum number of people allowed on the property', and 'NO GUESTS OR VISITORS SHALL BE ALLOWED' — the posted notice states the occupancy figure and repeats it. Each STR needs a written garbage-disposal plan naming the disposal company, posted inside and filed with the Code Enforcement Officer. The posted notice must also carry the noise ordinance (60 dB 7 a.m.–9 p.m., 50 dB 9 p.m.–7 a.m., no outside music after 9 p.m.), 'do not feed or attract wildlife', and no garbage can left out overnight unless in a commercial bear-proof container. VIOLATIONS may suspend or revoke the certificate on affidavit of law enforcement, the CEO or the Town Attorney, with three violations in 12 months or four in 24 months triggering suspension or revocation, and may also be prosecuted as zoning violations. SEPARATELY, GREENE COUNTY OPERATES A FREE SHORT-TERM-RENTAL REGISTRATION through its Customer Portal, and New York State now collects sales tax on short-term rental transactions (str@greenecountyny.gov, (518) 943-3223).
