ADUs vs. short-term rentals in Minisink
Short-term rentals restricted for Town of Minisink. AN INVESTOR WHOLE-HOUSE SHORT-TERM RENTAL IS NOT AVAILABLE IN MINISINK'S RESIDENTIAL DISTRICTS, AND THAT IS A READING OF THE USE LISTS RATHER THAN OF ANY SHORT-TERM-RENTAL LAW — Minisink has none. Read in full 2026-08-27 (114 pages, OCR'd from the scanned copy on the Town's Building Inspector page). The Town's Document Center carries no later zoning law — only ZBA agendas and a 2025 residential-development moratorium — and the § 5.6 'Prohibited Uses in all Districts' section the earlier note described is § 5.6 of this 2010 text. BOTH RESIDENCE DISTRICTS ARE CLOSED LISTS. § 3.1.1 (A-R Agriculture-Residence): 'no building, land or premises shall be used ... in whole or in part for any uses except the following.' § 3.2.1 (SR Suburban Residence) uses the same formula. THE CODE DEFINES THE ACTIVITY AND PUTS IT IN THE COMMERCIAL DISTRICT ONLY. Article XI defines 'Tourist Home — A dwelling in which overnight accommodations are provided or offered for transient guests for compensation' — language that squarely captures whole-house and room short-term renting. Tourist Home appears in exactly one use list: § 3.4.1.1(E), 'Motels, Hotels and Tourist Homes', a permitted use in the G-C General and Service Commercial District, where every use is subject to Site Development Plan approval by the Planning Board. It appears nowhere in A-R or SR. THE ONLY RESIDENTIAL LODGING ROUTE IS AN OWNER-OCCUPIED BED-AND-BREAKFAST, AND ITS CONDITIONS ARE WHAT FORECLOSE THE INVESTOR CASE. § 3.1.1.2(K) makes 'Bed and Breakfast (Residential)' a conditional use requiring Planning Board approval, subject to: (1) a maximum of five bedrooms for rental occupancy including sanitary facilities; (2) food service limited to breakfast and snacks; (3) OWNER OCCUPIED IN ADDITION TO RENTAL BEDROOMS; (4) no alcoholic beverage licence; (5) one parking space per rental bedroom plus two for the owner occupancy; (6) a public hearing before the Planning Board; and (L) any further requirements the Planning Board deems necessary. § 3.2.1.2(D) carries the same use into SR by reference to § 3.1.1.2(k)(1) through (6). The definitions confirm the short-stay character: Bed and Breakfast Residential Rental provides 'breakfast food service for transient occupants. This is not to function as a rooming house for long term (greater than one week) tenancy.' SO: on an A-R or SR house the achievable use is an owner-resident bed-and-breakfast of up to five let bedrooms won at a public hearing, not a let of the whole dwelling. Nothing in the code names 'short-term rental' and no permit or registration exists under that name, so an owner should get the Building Inspector's position in writing before underwriting short-term rental income — call (845) 726-3700 ext. 3. Since 2025 New York State requires every short-term-rental host to register the unit with the State through the county registry regardless of what the municipality allows. These are separate questions from whether you can build an ADU — a unit you're allowed to add isn't automatically one you're allowed to rent nightly, so check both. Municipal source
