Village of Wurtsboro, NY: zoning for new construction

Village of Wurtsboro does not publish a zoning code. We hold no districts, lot minimums or setbacks for it, and we would rather tell you that plainly than show you numbers we cannot stand behind.

What we know

The Village of Wurtsboro HAS a zoning law but publishes none of it. It is not on eCode360 or in any other code library, and the Village's own Planning & Zoning page lists a "Supporting Documents" heading with no documents under it. That the law exists is not in doubt: the Appellate Division applied "a formula provided by the Village of Wurtsboro Zoning Law" to a district zoned for cluster development in Sullivan Farms IV LLC v Village of Wurtsboro (2015), citing § 5.19. There is simply no public copy of the districts, lot sizes or setbacks.

How building actually works here

Every dimensional question here — district, minimum lot size, setbacks, height, permitted uses — has to come from the Village directly, because none of it is published. Ask specifically for the Zoning Law and its schedule of area and bulk requirements rather than for "the zoning", and ask whether your parcel sits in a district that permits cluster development, since the Village has approved cluster subdivisions before. Do not assume the Town of Mamakating's standards apply inside the village line.

If you are looking at a parcel just outside the village line, the zoning page is the right one — but check which jurisdiction the parcel is actually in first, because the two are easy to confuse and the standards are not the same.
